Section 1.
Power to appropriate private property.
Sections 3784 to 3810, being inclusive, of the Compiled Laws of the State
of Michigan for 1929, being Act 124 of the Public Acts of the State of
Michigan for 1883 [Repealed and replaced by MCL 213.361 et seq., as amended,
and Sections 3763 to 3783, both inclusive, of the Compiled Laws of the
State of Michigan for 1929, being Act 149 of the Public Acts of the State
of Michigan for 1911 [MCL 213.21 et seq.], as amended, are hereby specifically
adopted as a part of this charter and the village is hereby authorized
to take private property under either of the foregoing acts, for the use
or benefit of the public as provided for therein, Provided, however, that
no road, street or highway, alley or right of way shall be condemned under
the authority given in this Chapter, nor shall any proceedings be taken
by the council or otherwise, to initiate such condemnation within the
limits of the village between Jefferson Avenue, or Lake Shore Road so-called,
and the westerly limits of said village, paralleling any part of said
Jefferson Avenue, or Lake Shore Road so-called. Provided further that
all condemnation proceedings instituted thereunder affecting lands within
Wayne County shall be commenced in the Circuit Court for the County of
Wayne, State of Michigan, and proceedings instituted thereunder affecting
lands within Macomb County shall be commenced in the Circuit Court for
the County of Macomb, State of Michigan.
