Chapter 22  PARKS AND RECREATION*

ARTICLE I.  IN GENERAL

Sec. 22-1.  Rules and regulations; enforcement.
The village council shall adopt and may, from time to time, revise and amend rules and regulations to be observed by all persons using or enjoying any of the village parks or park facilities, including, but not limited to, Gerald C. Schroeder Athletic Field and Ford Park. Such rules and regulations shall be enforced by the village manager and his designee, including the department of public safety.

ARTICLE II.  GEORGE OSIUS PARK

Sec. 22-31.  Use of park and facilities; permit required.
The use and enjoyment of George Osius Park and the recreational facilities, pier, boat moorings and bath facilities in the park shall be and are hereby restricted to bona fide residents of the village and guests. Permits for the use of the park and facilities shall be required, and such permits shall be issued in accordance with rules and regulations adopted by the village council from time to time.

Sec. 22-32.  Rules and regulations.
The village council shall adopt and may, from time to time, revise and amend rules and regulations to be observed by all persons using or enjoying any of the facilities of George Osius Park.

Sec. 22-33.  General supervision; enforcement of rules.
(a) The village manager shall have responsibility for the general supervision of George Osius Park, its recreational facilities, mooring spaces, swimming areas and automobile parking areas.
(b) The village manager and the manager's designee, including the department of public safety, shall enforce this article and the rules and regulations adopted in accordance with section 22-32.

Sec. 22-34.  Liability for use of park and facilities.
(a) The village, in permitting the use by village residents of George Osius Park, the pier, bathing facilities, boat moorings, and parking and recreational grounds, shall not be charged with any responsibility and shall not be liable for any loss, injury or damage suffered by a permit holder, the guest of a permit holder or any other person while using or enjoying the park or any of its facilities. The village, in permitting boats to moor in the harbor, shall not be charged with any responsibility and shall not be liable for any loss, injury or damage by fire, theft, collision or any other cause. All boats shall be moored, harbored or used at the owner's risk.
(b) The applicant or holder of any permit under this article shall be liable to the village and to all other persons using the park or its facilities for any loss, injury or damage resulting from the negligence of such applicant or holder, and shall indemnify and hold harmless the village for any loss, injury or damage resulting from such person's negligence, including any costs, expenses or legal fees incurred by the village in connection therewith.
