Applications for All Permits can be obtained at the Village offices.

Sec.40-393. Appeal Process

(a) Appeals shallbe commenced by a person filing a notice of appeal, accompanied by such appeal fee as may be specified by the village council. The notice of appeal shall specify the specific grounds upon which the appeal is based, and shall be signed by the applicant. It shall also specify the requirements from which a variance is sought and the nature and extent of such variance.

(b) The notice of appeal shall also be accompanied by a fully completed application, using a form to be specified by the zoning board of appeals, along with plot plans meeting the rules of procedure adopted by the board.

(c) Every decision of the board shall based upon findings of fact, and each and every such finding shall be supported in the record of the proceedings of the board.

(d) In authorizing a variance or taking any other action within it's jurisdiction, the board may atttach such conditions as may be deemed necessary in the furtherance of the purposes of this chapter, provided, any conditions are in compliance with the three standards listed in section 40-423(3)a-c.

(e) Any person aggrieved by a final decision of the board may appeal to the circuit court.

Requirements for Application to Appear before Planning Commission

1. Twelve (12) sets of drawings per.

(a): Each site drawing, building plan and drawing shall be prepared by a professional planner, professional engineer, surveyor, landscape architect or architect, who shall place his or her seal and signature on all applicable plans, maps and drawings. Site or plot plans shall be drawn on sheets having a minimum sheet size of 18 inches by 22 inches and a maximum sheet size of 34 inches by 44 inches and shall be at a scale of 10 feet or 20 feet to the inch

(b): Sheet one (1) of all plans submitted for review shall have the following information:

  • Plot plan showing all structures and driveway location drawn to scale.
  • Square footage of lot, all existing structures and proposed addition.
  • Total percentage lot coverage including proposed addition.
  • Height of construction
  • Front, rear and side yard dimensions.
  • Type of material and color to be used for additions, new or accessory buildings.

If the above information is not shown, the Planning Commission will not review the plans

2. The schedule of deadlines for submission of all materials is on file at the Village Office.

Code of Ordinances; Section 40-202 RESIDENTIAL CHANGES AND DEVELOPMENT.

(a) The following residential plans shall be reviewed and acted upon by the Commission.

    1. Plans for appearance changes or accessory buildings which are referred to the
    2. Plans for new construction, reconstruction, additions, remodeling, or alteration of any principal structure, or of any accessory structure greater than 120 square feet which requires a building permit.
    3. Plans for new construction or substantial changes of fences, walls, hedges, berms and landscaping in the required front yard.
    4. Changes not in compliance with or deviations from the development standards in Sections 901 and 902.

(b) Procedures.
To facilitate review and approval, the following procedures shall be followed:

    1. A pre-application conference with the Village Manager to review the change or development as it is being proposed.
    2. Submission of an application for approval, with plot plan, building plan, architectural elevations, and such other information as the Village Manager or the Commission deem appropriate to assist the Commission in making a determination upon the application.
    3. Review by Commission.
    4. Revisions or additional submissions when applicable.
    5. Action by the Commission; approval; approval with modifications; or denial. If denied, the reasons shall be provided in writing as part of the minutes, with a copy of such provided to the property owner.

(c) Application for Approval.

    1. Sufficient copies of an application for approval shall be submitted by the property owner to the Village. The property owner shall also submit a filing fee to the Village in an amount specified on the fee schedule adopted by resolution of the Village Council. No plan shall be considered as properly filed until such time as the filing fee is submitted to the Village.
